We are pleased to announce our successful case in the Supreme Court of Lithuania, where CONFIDENCE Law Office defended the interests of a small and growing telecommunications business against Telia, a major player in the industry.
Telia, the dominant provider of wholesale broadband access, engaged in illegal practices by pressuring Consilium Optimum, a fast-growing Internet service provider, to accept new contract terms that would hinder fair market competition. Despite the refusal of Consilium Optimum, Telia breached existing contracts and unlawfully refused new orders.
Facing challenges from Telia, Consilium Optimum sought legal intervention. Unfortunately, both the Communications Regulatory Authority and lower courts initially failed to uphold the rights of the service provider. However, the Supreme Court of Lithuania, in a cassation appeal (civil case No. e3K-3-136-378/2023), overturned lower court decisions, reaffirming the validity of the existing contract.
Dr. Laurynas Didžiulis, representing Consilium Optimum, expressed surprise at the initial reluctance of regulatory authorities and lower courts to protect the rights of smaller businesses. Despite this, he commended the depth of legal argumentation and competence displayed by the judges during the Supreme Court hearing.
