On November 4, 2025, the Vilnius Regional Court issued a ruling in a civil case involving a dispute between UAB ,,Bitė Lietuva“ and an electronic communications operator represented by CONFIDENCE regarding unilateral changes to the terms and conditions of 5G service plans.

The court found that ,,Bitė Lietuva“ did not have the right to unilaterally change the terms and conditions of electronic communications service contracts when such changes worsen the customer’s position and do not comply with the requirements of the Electronic Communications Law.

The dispute arose after Bitė Lietuva informed the customer about an increase in the price of 5G plans and restrictions on the scope of services. The customer in Vilnius did not agree with these changes and defended his rights in court.

After assessing the circumstances of the case, the court recognized that the customer had the right to refuse to pay under the unilaterally changed terms and conditions, and ,,UAB Bitė Lietuva“ was ordered to pay the legal costs.

This decision is an important precedent in the electronic communications services market and a clear signal that service providers must comply with their contractual obligations and that unilateral changes cannot be made formally or by abusing a stronger position.
